This Sub-Declaration of Covenants, Conditions and Restrictions made by the Developer: STELAR CORP. a Florida corporation; with the approval, joinder and consent of the Master Association: Sun Valley Community Master Association, Inc.; and with the approval, joinder and consent of the Company: Sun Valley Equities Corp., a Florida corporation;
WHEREAS, Developer is the owner of the real property located in Palm Beach County, Florida, more particularly described in the Plat of Sun Valley P.U.D. I, according to the Plat thereof, as recorded in Plat Book 55, at page 45, of the Public Records of Palm Beach County, Florida; and the Plats of Sun Valley I-A and Sun Valley II which have been filed. with Palm Beach County, Florida for approval and recording, said lands being all of the lands currently designated for single family residential use by the Sun Valley P.U.D. Resolution of the Palm Beach County Commission; and
WHEREAS, Developer intends to develop the real property described above subject to certain protective covenants, conditions, restrictions, reservations, liens and charges as hereinafter set forth, and
NOW, THEREFORE, Developer hereby declares that all of the real property owned by it and described above shall be held, sold, conveyed, leased, mortgaged and otherwise dealt with subject to the easements, covenants, conditions, restrictions, reservations, liens and charges as hereinafter set forth; all of which are for the purpose of enhancing and protecting the value, desirability and attractiveness of said real property and to provide a uniform plan of development of the same. They shall run, with the aforedescribed real property and shall be binding upon all parties having and/or acquiring any right, title, interest, mortgage lien or encumbrance in the real property described above or in any part thereof. They shall inure to the benefit of each person or entity, from time to time, owning or holding an interest in said real property.
